Terms of service
Effective July 26, 2026
These terms govern use of TunedQuote, software provided by TunedQuote (“we,” “us”) that HVAC contractors (“contractor,” “you,” if you hold an account) use to build, send, and track equipment-replacement proposals for their own customers. By creating an account or using TunedQuote, a contractor agrees to these terms.
The service
TunedQuote lets a contractor build multi-option proposals, present them to a homeowner through a secure link, collect the homeowner’s electronic acceptance, and track the proposal’s status. We provide the software; the contractor is responsible for the content of every proposal they create and send.
Contractor responsibilities
Pricing, financing estimates, equipment specifications, and incentive amounts shown on a proposal are prepared and entered by the contractor. Monthly payment figures are estimates and subject to actual credit approval by the relevant lender. Incentive or rebate amounts represent potential savings whose eligibility must be verified with the issuing utility, manufacturer, or government program — TunedQuote does not guarantee eligibility or availability of any incentive.
The contractor is responsible for the accuracy of everything they enter, for holding the licenses required to perform the work they propose, and for complying with consumer-protection, contracting, and telemarketing/texting laws in their jurisdiction — including obtaining and documenting a homeowner’s consent before sending them any text message through TunedQuote.
Electronic signatures
Electronic signatures collected through TunedQuote are intended to create binding acceptance records under the U.S. ESIGN Act and state UETA law. Each acceptance freezes the exact accepted scope, pricing, and terms into an immutable, hash-verified record available to both the contractor and the homeowner.
Messaging terms
A contractor may only send a homeowner a text message through TunedQuote after confirming, in the app, that the homeowner agreed to be texted. By giving that confirmation, the contractor represents to us that consent was actually obtained. Messages are limited to a proposal link and occasional follow-up reminders about that same proposal — typically one to three messages per proposal.
Message and data rates may apply to the homeowner. Reply STOP to opt out at any time; reply HELP for help. Consent to receive texts is never a condition of purchasing anything. See our privacy policy for how phone numbers and message content are handled.
Subscriptions and billing
Paid plans are billed in advance on a recurring basis through our payment processor, Stripe, and renew automatically until canceled. A contractor can cancel at any time from Settings; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.
Availability and warranty disclaimer
We work to keep TunedQuote available and reliable, but the service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, TunedQuote will not be liable for indirect, incidental, special, or consequential damages arising from use of the service, and our total liability for any claim will not exceed the amount the contractor paid us in the twelve months preceding the claim.
Termination
We may suspend or terminate an account that violates these terms, misuses the messaging features, or is used unlawfully. A contractor may stop using the service and cancel their subscription at any time.
Changes
We may update these terms from time to time. If we make material changes, we’ll update the effective date above and, where appropriate, notify contractor accounts directly.
